The facility failed to identify an animal with a significant medical issue. On 9/16/23 at approximately 9:40AM a member of the public informed USDA personnel that there was a calf who couldn’t stand up, and who had been in the same position since yesterday. USDA personnel observed the animal, which was lying down with its back legs splayed out in an abnormal position. USDA personnel notified one of the auction veterinarians, who oversaw the movement of the animal into a trailer. The animal was unable to stand so employees carried the animal. The veterinarian stated that the animal had not been consigned to the auction this weekend, but was left over from an earlier sale. The veterinarian stated that he did not have the authority to treat the animal and so it was loaded on a trailer and taken off site without receiving medical treatment. Daily observation of animals is important for the prompt identification and treatment of medical issues. Animals who are not observed adequately may suffer from medical problems that go untreated. Correct by 9/17/23 by ensuring that daily observation is conducted so that medical issues are identified and communicated to the Attending Veterinarian promptly and so that medical care can be provided.

In the warm room building, members of the public were observed touching rabbits who were in cages stacked on wagons. Additionally, during the auction, in the staging areas near the sale ring, members of the public were observed touching several animals including a capuchin monkey, a kinkajou, a fox, and skunks. In these areas, although the facility sporadically had readily identifiable employees on hand, the employees did not serve as effective barriers to stop members of the public from touching the animals. Effective distance and/or barriers are important for ensuring that members of the public do not cause harm to the animals or become injured themselves. Correct by ensuring that animals are exhibited so there is minimal risk of harm to the animal and public and the facility must ensure that there are barriers with sufficient distance to assure the safety of both.

A majority of the primary transport enclosures for rabbits did not contain adequate handholds or projecting rims. Approximately 90% of enclosures did not have projecting rims to ensure adequate ventilation is maintained, or handholds to prevent tilting and contact with the animal. Projecting rims and handholds on transport enclosures is important for ensuring adequate ventilation when cages are stacked, and proper handling when moving cages. Correct by ensuring that rabbit transport crates are complaint with the AWA regulations including having projecting rims and handles.

On the morning of September 15, 2023 at approximately 9:00 AM Eastern Time, UDSA personnel inspected rabbits which were located in the “warm room” building; most or all of these rabbits had been present overnight. Some of the rabbits had no drinking water. When water was provided some rabbits drank ravenously for a prolonged time. A black male Flemish giant rabbit (tag #6659) drank for over 4 minutes, requiring the water cup to be refilled. A grey and black female rabbit (tag #4058) drank for over 2.5 minutes when water was provided (this animal had small babies in the enclosure with her). A female white lionhead rabbit (tag #4059) drank for more than 40 seconds when water was provided (this animal also had small babies in the enclosure with her). The facility representative was informed and the remaining rabbits who didn’t have water were promptly provided with water. One female white rabbit and 7 kits (tag #4102) was extremely restless and hungry. The rabbits were trying to reach a half-eaten carrot that was beside their cage. When USDA personnel placed the carrot into the cage, the rabbits ravenously ate it, pushing each other out of the way. The kits continued to lick the bars of the cage where the carrot had been. Facility staff were informed and the rabbit was provided with food. The morning of 9/16/23 some cages of rabbits had empty or no water bowls. USDA personnel requested that water be provided to the cages, and when it was provided the rabbits showed signs of extreme thirst: A brown lop eared rabbit (tag 5626) drank water for 4 minutes, a grey rabbit (tag 4454) drank for 2 minutes, a brown Flemish giant rabbit (tag 7725) drank for over 2.5 minutes, and 5 young rabbits in one cage (tag 7716) drank for 5 minutes (pushing each other out of the way to get to the water bowl). Food and water are important for animal health and wellbeing. Animals that do not have adequate food and water may suffer from thirst, hunger, dehydration, low blood sugar, or death. Lactating female animals require more water in order to produce milk for their offspring. Correct by 9/17/23 by ensuring that rabbits in transport for more than 6 hours have adequate quantity and quality of food and drinking water.

A capuchin monkey (tag 8219) was contained in a transport enclosure that had no handle, no protruding rim for ventilation, and for which the openings in the sides of the enclosure were large enough to allow the animal to reach through. Cages for other nonhuman primates including an infant ring-tailed lemur (tag 8036), and an infant squirrel monkey (tag 6756), also had ventilation openings that were large enough to allow the animals to put limbs outside the enclosure in a way that could cause injury to the animal. The squirrel monkey was observed repeatedly putting its arms through the openings in the wire door of the enclosure. Animals that put body parts outside of their transport enclosure may become injured or may injure other animals nearby. Correct by ensuring that nonhuman primates are contained in enclosures that keep all body parts inside the enclosure.

Many animal transport enclosures did not have projecting rims, adequate ventilation, or handles. For example, two chinchillas (tag 4545 and 4544) were in wood and wire enclosures that lacked handles and projecting rims. Three foxes (tag 7702, 7701, 7700) did not have adequate space to turn around and make normal postural adjustments. A fox (tag 7871) was contained in a wire crate that did not have handles or protruding rims. A juvenile opossum (tag 7870) was contained in a crate that only had ventilation openings on the top. Numerous hedgehogs were contained in wood and wire transport enclosures that did not have protruding rims or handles. A lack of appropriate openings, adequate space and ventilation, projecting rims, and handholds on primary transport enclosures can make it difficult to remove the animal in the case of an emergency, allow for inadequate ventilation particularly when the cages are stacked when placed on the cart to move between the auction floor and holding area, and can cause unintentional contact between the handler and the animal during transport. Correct by ensuring that all primary transport enclosures for subpart F animals contain openings that are always easily accessible for emergency removal of live animals, contain projecting rims or other devices on the exterior walls to prevent obstruction of the ventilation, provide the animals with adequate space and ventilation openings on the sides of the enclosures, and provide adequate handholds for lifting animals without tilting or risk of contact with the animal.

Two primary enclosures failed to securely contain the birds within- one Pigeon escaped on 9/14/23, and a pheasant was observed in the rafters of the barn on the morning of 9/15/23. Numerous birds were observed sticking their heads or tails outside of their enclosures. Many enclosures were constructed so that birds could not be safety removed in the event of an emergency. At time of inspection the following animals were identified as needing veterinary care: - Two turkey hens had significant feather loss on their wings and backs. These two hens were observed to be self plucking feathers on their backs. - Light Braham hen had significant feather loss on her back. - One small white rooster had feather loss on his neck and chest. One large red rooster in the same enclosure had significant feather loss on his neck, chest, and left wing. -One brown hen had feather loss on her wings and back. - One cream hen had feather loss on her wings and back, and one cream rooster had significant feather loss on his neck and chest. -One grey hen had significant feather loss on her wings and back. -Six chickens were housed in a "sick pen" in the middle row of bird pens. The avian caretaker was treating these birds for unspecified illnesses with oral oxytetracycline. One chicken was found dead in this enclosure during the inspection. The caretaker had not consulted with a veterinarian regarding the health problems observed in these birds or the treatments he was administering. The written program of veterinary care on file does not include birds. There were no observation records for the above animals or treatments administered. The facility contacted a new attending veterinarian regarding the feather loss, but she has not visited the facility yet. The facility did not contact or consult with the veterinarian about the birds in the sick pen being treated with oxytetracycline. Feather loss can be caused by many factors including: an aggressive rooster, overbreeding, molting, mites, parasites, bacteria or fungal infections, poor nutrition, stress, boredom, bullying, and feather pulling. Open red exposed skin can lead to more aggression from other birds in the enclosure resulting in injuries and death. Birds that appear sick can be due to a variety of health conditions that require consultation with the veterinarian for accurate diagnosis and treatment. Licensee must establish and maintain a program of adequate veterinary care that includes the use of appropriate methods to prevent, control, diagnose, and treat diseases and injuries. The turkeys and chickens listed above must be examined and treated as directed by the attending veterinarian to prevent worsening of the conditions and unnecessary suffering. Additionally, the licensee must provide documentation of such examination and treatments to APHIS officials upon request.

The black water tub in the enclosure housing 4 hens contained dirt, debris, and algae adhering to the sides and bottom of the container. The inspector asked the avian caretaker to drain the tub and provide water in another container. Failure to provide fresh, potable water, and keep receptacles clean can result in illness and death. Potable water must be provided in sufficient quantity to all birds housed at the facility. Water receptacles must be kept clean and sanitized in accordance with section 3.158, as often as necessary to prevent contamination. Licensee must provide potable water to all birds, keep water receptacles clean and sanitary to protect the health of the birds.

Two turkeys and 6 chickens had significant feather loss. Feather loss can be caused by many factors as previously described under the veterinary care section 2.40(b)(2). There are no records of observations for any of these birds, treatment records, or record of any bird deaths. Birds are not currently on the written program of veterinary care and there was no documentation birds with feather loss were being treated. The bird caretaker stated that the feather loss was due to the normal breeding season (May through August). Caretaker also stated that he was not currently saving the fertilized eggs. He attempted to protect hens with feather loss with saddle covers, but majority of the covers came off. Several chicken enclosures had more than one rooster and the turkey enclosure had two toms. Birds may not be housed with other animals, including their own species, unless they are compatible, do not prevent access to food, water, or shelter areas, and are not hazardous to the health and well-being of each other. Licensee must ensure that birds are compatible and are separated when there are injuries, illness, health concerns, overly aggressive birds, or overbreeding. A new attending veterinarian has been consulted about the feather loss, but she had not visited the facility yet to do an evaluation. Most of the raptors at the facility were in their indoor enclosures which do not provide enough space for adequate freedom of movement. The birds while housed indoors are housed in stainless steel enclosures that do not allow them to fully extend their wings or make normal postural and social adjustments such as change perches and footing. These birds spend up to 12 hours in these enclosures when not outside in the mews. The facility states that they cannot maintain the birds overnight in their large outdoor mews due to potential safety concerns. - One fallow deer had two lesions on the right side of its neck. One lesion was approximately one inch by two inches. The affected area was hairless and crusting. The top portion of the lesion was reddened with scabbing. The second lesion was approximately three inches by four inches. The affected area was hairless with significant scabbing and dried blood. Cracks in the scabbing revealed bright red patches, consistent with bloody and reddened skin. - One gray fox had a yellowish green discharge from both eyes. The skin around both eyes had areas that were bright pink. The globe of each eye was also grayish blue with a cloudy appearance. - A young camel in the petting area of the zoo was thin. The entire length of both back hindlimbs and the tail were caked with dried fecal material. The tail was so severely affected that the hair was matted with fecal balls. - One lionhead rabbit had areas of matting hair around the neck and front legs. Lack of veterinary diagnosis and treatment can lead to prolonged suffering and pain. Each dealer shall establish and maintain programs of adequate veterinary care including the use of appropriate methods to prevent, control, diagnose, and treat diseases and injuries. -While on the wagon ride used for the public to feed the animals in the drive-thru portion of the facility a zebra was seen kicking a duck with its back leg causing the duck to roll on its back and was unable to right itself. After the zebra kicked the single duck, an eland was startled at the wagon and ran away stepping on numerous other ducks. -According to the facility, one round bale of hay is fed nightly. The animals receive their daily grain allotment throughout the day from wagon ride participants. The wagon the inspectors were on the first wagon ride of the day. There was no evidence of a round hay bale in the enclosure. The animals gathering around the wagon were very aggressive to get at the grain being fed. Animals with horns and antlers were observed pushing other animals away. The llamas, alpacas, and sheep would not approach the wagon. The licensee stated that this was normal for the first wagon ride of the day. - There were dig barriers in the exercise yard for the dogs. There were numerous areas of this dig barrier fence that had been dug up and were sticking up above the ground. - The shade shelter in the exercise yard had two, two by four boards with sharp points. These points were the tips of screws sticking downward at the point where the animals access the shelter. - The dividers for the outside pens were composed of aluminum rods. The gaps between the rods were approximately 3-4 inches. To prevent small dogs and puppies from squeezing between the rods, the licensee lined the rods with a one-inch by one-inch welded wire fence. -There were two areas of fence in the primary enclosure for the pig housed with two sheep in disrepair. One in the left front corner where one strand of the four inch by four inch wire has come loose, and another the entire six foot length of fence on the right front of the enclosure. Both of these areas had sharp points. - The primary enclosure housing three African crested porcupine had a patch of fencing materials that measures approximately eight feet by four feet with both ends having sharp, rusty points. The food dish had a hole in it that has sharp points facing upward into the bowl and the dig barrier fencing has been exposed under the tree limbs. - The two adult production pigs had an area of fencing that measures approximately two feet by three feet that has been cut out leaving sharp points around the cutout. - The primary enclosure for eight goats had a large propane tank for the restaurant. A goat was standing on top of the propane tank where there are valves and tubing that go into the restaurant for use. - The primary enclosure for the two silver fox had several areal in the corners where the dig barrier was exposed. - The primary enclosure housing two calves and two donkeys had a wire running through the middle of it. When the lead inspector asked what it was the licensee stated it was an electrical wire that used to be used. When the lead inspector asked if it was a “hot” wire the licensee stated yes. - The primary enclosure for the two white-tailed deer fawns had an enclosure clad in metal. The metal flashing around the door has been pulled away on the outside and the inside, causing sharp edges and points. - The primary enclosure housing two zebu and two cows had an area of fencing that had become loose. There were two stands of the two inch by four inch fence that have sharp points. - The primary enclosure housing three adult female goats had a run behind the barn with a section of fence that was not attached at one end. The facility must be constructed of such material and of such strength as appropriate for the animals involved. The indoor and outdoor housing facilities shall be structurally sound and shall be maintained in good repair to protect the animals from injury and to contain the animals. All housing facilities for animals must be structurally sound and maintained in good repair. To be corrected by October 1, 2023

-There was no shelter from inclement weather provided for the animals in the drive-thru primary enclosures. There was limited shade provided by the line of trees outside of the fence. These animals include the three eland, three water buffalo, one wildebeest, five nilgai, five zebra, three camels, three llamas, two pigs, seventeen fallow deer, eight alpaca, five elk, approximately thirty cows, and three yak. -The shelter provided for the skunk was an open-ended plastic tube. -The primary enclosure housing the seven pigmy goats did not have a shelter. -There was no shelter in the primary enclosure of the marbled fox. The licensee stated that he had taken the shelter out because it was falling apart and thought that building a new one would be a good winter project. -There was only one calf hut shelter in the primary enclosure for the ten sheep and one Scottish highland calf. Not all animals were able to fit in the shelter at the same time. -The shelter in the primary enclosure of the red kangaroo did not provide shelter from the elements. There were vertical gaps of approximately one inch between all of the pieces of wood on the three sides of the shelter. - The shelter in the primary enclosure for the three dairy goats was too small to contain all three animals at the same time. -The shelter in the primary enclosure of the two cows and two donkeys was not large enough to contain all the animals at the same time. Providing shelter and shelter large enough to protect all animals simultaneously from the elements is important to prevent discomfort of the animals. Exposure to direct sunlight can cause animals discomfort and can cause them to overheat. All animals must be provided with shelter and shade appropriate for the local climatic conditions. There was no perimeter fence for the drive-thru primary enclosure that housed the three eland, three water buffalo, one wildebeest, five nilgai, and three yak. A perimeter fence is required to ensure that the animals are protected from unauthorized persons and animals which may intend to have contact with them and functions as a secondary containment system for the animals. A perimeter fence must be constructed so that it protects the animals in the facility by restricting animals and unauthorized persons from going through it or under it and having contact with the animals in the facility, and so that it can function as a secondary containment system for the animals in the facility. It must be of sufficient distance from the outside of the primary enclosure to prevent physical contact between animals inside the enclosure and animals or persons outside the perimeter fence. - The primary enclosure that contained the ostrich, rhea, and emu had an area of fencing with protruding sharp points approximately three foot in vertical length. -The metal roof of the primary enclosure of the Amazonian parrot had pulled away from the primary enclosure in the back left. All of the birds in the drive through area of the zoo were housed with mammals of various size. These animals include eland, nilgai, buffalo, elk, zebra, camel, cattle, and yak. While on the wagon ride used for the public to feed the animals in the drive-thru portion of the facility a zebra was seen kicking a duck with its back leg causing the duck to roll on its back and was unable to right itself. After the zebra kicked the single duck, an eland was startled at the wagon and ran away stepping on numerous other ducks. The lead inspector had to ask the driver to stop to pick up the duck that was kicked by the zebra so that veterinarian could be called, and the duck could receive veterinary attention. The duck was put at the drivers feet and was unable to stand. The licensee stated that the animals get their only ration of grain from the wagon rides. The licensee also stated a round bale of hay is fed every night. Birds do not eat hay and therefore only get their ration of food during the wagon rides. The ducks competing with these large animals for food shows that they are hungry. This co-mingling of mammals and birds when feeding is leading to bird distress and injury. Birds cannot be housed with other birds and/or mammals that prevent access to food, water, or shelter by individual animals, or be hazardous to the health and well-being of each other. Birds may not be housed with other animals, including members of their own species, unless they are compatible. Compatibility must be determined in accordance with generally accepted professional practices and by actual observations to ensure that the birds are, in fact, compatible. On the morning of 9/7/2023 the licensee said he let the seven dogs in the different outdoor runs all go together into the larger exercise area while doing chores and some of the dogs got in a fight before they could be separated. Male poodle (#216) had bite wounds with a deep wound on his right hind leg. The licensee reported the incident to the attending veterinarian (AV) and then took #216 to the AV the same day and has been caring for the wounds and giving medication per the AV's instructions. The AV confirmed that it was in the clinic, treated, and that daily care instructions are being followed and that a deep bite wound will take possibly up to a month to heal since deep bite wounds cannot be closed (sutured/stitched) due to higher risk of infection if closed. During a sale in order to show the animal to potential buyers the owner removed a Bat Eared Fox from its transport enclosure. The animal was struggling while being held and appeared to be stressed by the noisy environment. While attempting to secure the animal back in the enclosure, the fox was dropped. Instead, one male Thomson’s gazelle was added to the licensee’s acquisition record dated April 21, 2023, by the licensee. Per the sending facility's records, the male gazelle was transferred to the licensee on September 7, 2022 in a previous shipment. An accurate record of animals acquired, owned, held, leased or otherwise in the facility's possession is required for medical and legal tracking purposes.
