* There was a 6 foot, chain-link, perimeter fence surrounding the entire circus including the tigers' primary enclosures and their exercise enclosure. A drive-through gate in that fence was left open and unattended several times during the inspection. The open gate was approximately 100 feet away from and in plain view of the tiger transport trailer and enclosures. There was a fence immediately around the tiger transport enclosures, but it was only 4 feet tall and was within arms reach of the enclosures. At one point, the gate was left wide open after the tiger caretaker and much of the rest of the circus staff left the premises for a break. An unauthorized person could have easily approached and made contact with the tigers at that time. * Perimeter fence gates left open and unattended do not adequately prevent unauthorized personnel from coming in contact with the animals and do not adequately function as secondary containment systems. This could result in something harmful happening to the tigers or the public. *** The licensee must ensure the tigers' primary enclosures are contained within a secure perimeter fence which is at least 8 feet tall and 3 feet away from the enclosures OR provide appropriate alternative security measures. TO BE CORRECTED BY: this non-compliant item was corrected prior to the end of the inspection. The inspection was conducted on 22-23 July 2014 with a facility representative. A verbal exit interview was conducted in person with a facility representative and via telephone with the licensee on 23 July 2014. ***An adult tan and white male Chihuahua named "Checker" (ID # 107 059 817) has a whitish-gray film over the lower portion of the left eye, covering approximately 50 percent of the eye surface. The licensee stated that the dog was acquired with this problem, but has not been evaluated by a veterinarian. ***An adult female black and white Chihuahua named "Mindy" (ID # 264), has a growth in the lower inner corner of her left eye. The growth is red, oblong in shape, and moist looking. It is approximately the size of a pencil eraser. The licensee stated the veterinarian has looked at the eye growth and stated it is not causing the dog problems; however, there was no documentation available at the time of the inspection. ***An adult golden sable female Lhasa Apso named "Hillary" (ID # 107 273 106), has a greenish-tan discharge on about 30 percent of the surface of the left eye and around the edges of the eyelids. Some of this discharge has dried to a crust around the edge of the eyelids and is crusted in the fur on the inner corner of the eye. Eye problems can be an indicator of injury, disease, allergies or irritation, and can be painful and/or itchy, and can affect the health and well-being of the animal. The licensee must consult with a veterinarian for proper diagnosis and to develop and follow a treatment plan by the close of business July 29, 2014. The cheek teeth on the left side have receding gums, the cheek teeth on the right side are missing. The upper right molar has a white, creamy discharge at the gum line. ***An adult silver and tan female Yorkshire terrier named "Janelle" (ID # 069 310 367), has a thick, grayish-brown material covering all surfaces of upper molars, cheek teeth, and front teeth. The lower teeth have a moderate amount of this material adhered to the teeth. The gums on both upper sides of the teeth are reddened, swollen, and receding away from the teeth. Above the right molar, there is a creamy white discharge at the gum line. Dental problems can be painful, make it difficult to eat, lead to the development of other health problems, and can affect the health and well-being of the animal. The licensee must consult with a veterinarian by close of business July 25, 2014 for a proper diagnosis and to develop and follow a treatment plan. In the whelping building there are two six month old fawn pugs, a male and a female, that had no identification. Inside the first sheltered housing building are 14 enclosures affecting a total of 38 adult dogs with excess rust on the metal bar along the bottom of the front of the enclosures. The rusted surface is rough, flaking with several of the metal bar deteriorating causing it to lose its structural strength. On the outside of the "Reefer/Cooler Building" near the dog door in 4 enclosures affecting a total of 25 adult dogs is an excess amount of rust on the wall which does not allow the area to be properly cleaned and sanitized. Rusted surfaces prevent adequate cleaning and sanitization which can play a role in disease transmission. The licensee must maintain all surfaces in housing facilities so that they are free of excessive rust that prevents the required cleaning and sanitization. To be corrected by September 11, 2014.

Inside the "Small Blue Building" the first enclosure (left side) housing 5 adult dogs the plastic sheet on the wall is ripped/shredded leaving exposed wood. The exposed wood is next to the animals and does now allow for proper cleaning and sanitizing. In the "(cid:28)Pug Shed",(cid:29) the wooden guillotine doors on enclosure numbers 1, 3, 4, 6, 7, and 8 have paint that is worn off and exposing the wood underneath. These surfaces are no longer impervious to moisture and can no longer be properly cleaned and sanitized. Surfaces that cannot be properly cleaned and sanitized can play a role in disease transmission. The licensee must ensure that all surfaces in contact with the animals be maintained on a regular basis, and any surface that cannot be properly cleaned and sanitized must be repaired or replaced.

In the outside run of the Reefer/Cooler Building, the farthest enclosure on the south side housing five adult cocker spaniels has an excess amount of feces and debris piled up against the fence on the west side. A buildup of feces causes odors, attracts insects, pests, and other vermin, and is a disease hazard. The licensee must ensure fecal material and other debris is removed often enough to ensure odors are kept at a minimum, insects and pests are not attracted, and disease hazards are eliminated. Inside the "Reefer/Cooler Building" the plastic feeders inside the five enclosures housing a total of 30 adult dogs has excess amount of dirt/grime build-up on the outside indicating that the receptacles have not been properly cleaned and sanitized. There is one food receptacle with chewed edge inside the "Small Blue Building". The chewed edge is deeply pitted making it difficult to sanitize. When surfaces are not sanitized they can play a role in disease transmission. Food receptacles that are not clean and sanitized can lead to disease transmission, decreased appetite, and when the receptacles become worn or chewed to the point they cannot be sanitized, they must be replaced. **** A prairie dog located in the back of the museum had approximately 30 to 40% hair loss on its left side and flank area at the time of inspection. The skin did not appear to be red or irritated. The licensee stated the animal had been evaluated by a veterinarian in February of this year but there was no supporting medical documentation. The licensee stated that the hair loss has worsened since the evaluation by the veterinarian. Hair loss can be an indication of bacterial, fungal, or parasitic infections as well as a psychological stress. This prairie dog must be examined by a licensed veterinarian to ensure that an accurate diagnosis is obtained and an appropriate treatment plan is developed and followed. **** On the bottom edge of the keeper's door of a prairie dog enclosure, were numerous scattered insect excrement as well as a live roach-like insect on the inside edge of the keeper's door. Lack of an effective pest control program can create unsanitary conditions and lead to the potential spread of disease. ****The left front leg of the male prairie dog housed in the jungle area was missing from the carpal joint distal. This prairie dog was non-weight bearing on the left front limb. The facility representative stated that the leg has always been this way. The attending veterinarian had not been consulted nor had any treatment been provided at the time of inspection. Limb problems can be painful causing discomfort. It can affect the mobility and daily activity of the prairie dog. ****The rear left hind foot of the female prairie dog housed in the jungle area had excessively long toe nails such that one nail was curled to approximately 360 degrees. Excessively long toe nails can cause the animal pain and discomfort and can grow into the toe pad, causing damage, lameness, and possible infection. Lack of nail care on a regular basis can affect the health and well-being of animals. The licensee must establish a nail trim maintenance program. These animals must be examined by a licensed veterinarian and appropriate treatment administrated. The outcome of this examination must be documented and provided to the inspector upon request. **** In the capuchin enclosure there was a mixture of dirt, grease and other excreta on the plastic entryway door to the nesting box. This area contained their food bowl and allowed the animals to be off exhibit. The affected area covers approximately 40 to 50 percent of the plastic entryway door. Sanitization of surfaces is necessary to prevent an accumulation of excreta and other disease hazards. This indicates an unsanitary living condition exists that could lead to potential disease or health risks. Parasites, flying insects and other flies may carry diseases that can be spread and transferred throughout the facility where the animals are contained. (b)(2) Records for a male lion named Robin indicated that he was euthanized by gunshot without prior evaluation by a licensed veterinarian. His records indicate the attending veterinarian was contacted by phone, she diagnosed severe ataxia by phone, and approved euthanasia without examining the animal. According to the records this animal was only 12 to 13 years old and had no prior history of neurologic issues. The licensee is responsible for ensuring appropriate methods to diagnose and treat illnesses are provided to resident animals. The licensee is also responsible for ensuring veterinary care will be available for emergencies, weekends, and holidays. The licensee failed to ensure appropriate care was given to this animal by failing to find another veterinarian able to visit and examine this lion in person. This lion was euthanized for what might have been a minor problem that could have been easily resolved if seen by a qualified veterinarian. The licensee must have a licensed veterinarian evaluate all animals in person prior to euthanasia in order to ensure all animals are provided with appropriate diagnosis and treatment prior to euthanasia. (a) ***** At time of inspection the chain-link fabric used for the enclosure located directly west of the leopard enclosure consisted of several different sized pieces of chain-link fabric. Where the two eight foot sections where joined together there were several locations which had not been fastened together they were simply overlapping each other. There were several places where they were not fastened to the posts used to support the construction, At the top there was no top rail or tension wire which was securely fastened to the posts for supporting the chain link fabric. This was the construction of the south wall of this enclosure. The walls of the rest of the enclosure consisted of chain-link fabric in various sizes with the use of a tension wire along the top which was not attached to the post supports and in some locations missing entirely. ***** In the enclosure next to this enclosure to the north it was constructed of chain-link fabric and posts with what was to be considered a 45 degree kick in of chain-link material along the top. The fabric along the top sagged in many places from having no top support such as a tension wire or top rail. This fails to provide the type of system that is considered appropriate to maintain the enclosure in good repair and the animal securely within the enclosure should it decide to attempt to escape. (b) ***** At time of inspection the concrete block housing units for both the Leopard and Cougar were to narrow and not long enough to completely protect the cats from the elements and to prevent discomfort from the elements. The cats had to lay one of two directions only, facing towards the front or rear of the longest measurement of the housing unit. When facing forward such as the leopard at time of inspection its flanks touched the back wall of the housing unit while it had its front legs tucked beside its body and its head stuck out of the front of the housing unit. The width dimension of the housing unit would not allow for either animal to lie, it was far too narrow. These units had an overhang on the roof which would have been the appropriate length for the housing unit itself to provide for the protection and comfort of the animals. The width should be of a similar dimension which would allow for the animals to lay in either direction comfortably. ***** At time of inspection the single housed male lion had been provided with a concrete block housing unit which met the provisions that a housing unit should. It was long enough and wide enough to provide protection from the elements and prevent discomfort to the animal. Ventilation for this unit was provided by the entrance to the housing unit. The animal had sufficient shade provided so that ventilation was not a factor at this time. ***** At time of inspection the concrete pads that had been poured in the enclosure housing the two tigers and the enclosure with the three lions were of a size sufficient for one animal only. When the Director was asked if a housing unit for each animal in the enclosure equivalent to the pad size poured was to be provided for each animal the answer was no that the pad currently poured was to be the housing unit for the animals in the enclosure. After seeing the unit for the single lion the inspector asked the director if the proposed pad size and housing units would be large enough for all the animals to enter at one time and be provided protection from the elements, could move about freely, sit, stand and lie in a normal manner the answer was no that they needed to be larger. These units which are not large enough for all the animals to enter at one time, need to be enlarged or multiple housing units which can accommodate all animals in the enclosures need to be constructed which will provide protection of the animals from the elements and prevent discomfort to the animals. The choice of materials to provide housing for these animals is that of the licensee. That choice also comes with the requirement to maintain that choice of materials in good repair. There is one enclosure in the breeding stock area that has an area where the coated wire is broken. The section of damaged wire is along the bottom right of the enclosure next to the food receptacle. The two reindeer cows had overgrown hooves to the point that the front dewclaws made contact with the ground and, for the cow named Bossy, the front toes were starting to cross. Excessive hoof growth can contribute to abnormal gait which can cause a change in the toe joints and may contribute to osteoarthritis especially in older animals such as these. The facility needs to have a better plan to manage the growth of the hooves to prevent them from getting too long instead of only once a year when the antler velvet is shed. The attending veterinarian was contacted immediately following the inspection to setup an appointment for hoof trimming and evaluation of the animals. The program of veterinary care must include appropriate methods to prevent, control, diagnose, and treat diseases, injuries, and other conditions that may arise. To be corrected by 7/31/2014.

Multiple attempts have been made to contact this licensee with negative results. I stayed for 30 minutes in the driveway calling the licensee on the numbers provided. The home phone has now been disconnected and the cell phone is set to not take any messages. The licensee has never returned any phone messages or tried to make contact with this inspector and has not been inspected once since he became licensed. This licensee has actively refused to communicate with the inspector to allow an inspection and has continually made no effort to work out any arrangements for future inspections. Attempts have been made on multiple days and times with no results, and the licensee has not communicated any 'optimal times for inspection' options after repeated messages and 'attempted inspections' requesting this information.
